Terms & Conditions

These Terms & Conditions (“Terms”) govern the use of appraisal services provided by Syan & Associates (“Company,” “we,” “our,” “us”). By engaging our services, you agree to these Terms.

1. Scope of Services

We provide residential real estate appraisals for properties ranging from single-family homes to four (4) units, and up to five (5) units if the fifth is a detached garden house.

Services are available only in Ontario, Canada, specifically within the Greater Toronto Area (GTA).

Our primary clients include banks, private lenders, and relocation companies; however, individuals may also request services.

2. Ownership of Reports

Appraisal reports are the intellectual property of the appraiser.

Clients receive the right to use reports for the specific purpose intended (e.g., financing, relocation).

Reports must not be redistributed, altered, or used for purposes outside the agreed scope without written consent.

3. Record Retention

Appraisers are legally required to retain appraisal files for seven (7) years in accordance with AIC regulations.

Records may be accessed by the AIC for audit or investigation purposes.

4. Payment & Fees
-
Fees for appraisal services are communicated prior to engagement.

Payment terms must be agreed upon before delivery of the report.

Refunds and cancellations are handled on a case-by-case basis and are not guaranteed once an appraisal has been conducted.

5. Client Responsibilities

Clients must provide accurate, complete information and allow reasonable access to the property.

Clients are responsible for ensuring legal rights of entry to the property.

Providing false, misleading, or incomplete information may void the appraisal or result in liability for the client.

6. Liability Disclaimer

Appraisals represent the professional opinion of the appraiser based on available data at the time of inspection.

We are not liable for market fluctuations, reliance by third parties, or outcomes of financial decisions made using our reports.

We are not responsible for errors in third-party data (e.g., GeoWarehouse, MPAC, municipal records).

7. Dispute Resolution

Disputes and complaints are handled in accordance with the Appraisal Institute of Canada’s (AIC) Complaint Investigation Committee procedures.

Complaints must be filed directly with the AIC, which will conduct an investigation and render a decision.

8. Website Use

Users of our website must not engage in unlawful or unauthorized activities (e.g., hacking, spamming, unauthorized copying).

Any use of website content requires written permission.

9. Governing Law
These Terms are governed by the laws of Ontario, Canada.

10. Updates
We may revise these Terms at any time by posting the updated version on our website. Continued use of our services indicates acceptance of the revised Terms.
